Purpose and Scope of Legal Aid
Legal aid ensures that individuals who do not have the financial means to pay for attorney fees and litigation expenses can still exercise their constitutional right to a fair trial.
The Istanbul Bar Association appoints attorneys for eligible citizens free of charge. This service covers civil, family, enforcement, and administrative cases, ensuring that financial inability does not prevent access to justice.
It is an essential mechanism for protecting the rights of vulnerable groups, including victims of domestic violence and marginalized communities.
Application Requirements
To qualify for legal aid, the applicant must explicitly prove their financial inadequacy. The primary criterion is that paying attorney and court fees would cause severe financial hardship for the applicant and their family.
Applicants must not have significant assets, high-income employment, or property that could be sold to cover legal expenses.
Furthermore, the legal claim must have a reasonable chance of success. Frivolous lawsuits are not covered by the legal aid system.
Required Documents for Application
Applicants must gather a specific set of documents before applying. This includes a poverty certificate (fakirlik belgesi) obtained from the local neighborhood headman (muhtar).
Additionally, the applicant must provide a Social Security Institution (SGK) service breakdown, tax office records, and property registry documents (tapu kaydı) to prove they do not own significant real estate.
Vehicle registration records and a detailed petition explaining the nature of the legal dispute are also strictly required.
The Evaluation Process
Applications are made directly to the Bar's Legal Aid Bureaus in Istanbul. The bureau conducts a preliminary review of the documents.
If the applicant meets both the financial criteria and the legal merit requirement, a volunteer attorney is appointed to represent them. The attorney’s fees are paid directly by the Bar Association.
In cases of urgency, such as domestic violence requiring protective orders, the bureaucratic process is expedited to ensure immediate legal protection.
